Background: Doctor–patient sexual relationship is considered to be unfair because the first party would be abusing the second party’s vulnerability. The prohibition of this relationship is noted in the Hippocratic oath. Currently, a reprise of the use of oaths in medical schools can be observed.Aim: To determine whether the prohibition has been maintained and how its expression has varied in the oaths during different periods.Methods: 50 oaths were studied: 13 ancient–medieval and 37 modern–contemporary. Of the 50 texts, 19 were versions (...) of the original oaths. The oaths that pointed out the prohibited doctor–patient relationship referred to any sexual aspect or included paragraphs that began as the Hippocratic oath does were noted.Results: Of the 24 texts that expressed the prohibition, 8 were ancient–medieval and 16 were modern–contemporary. Some expressly call it Hippocratic oath, many use general terminology and others describe it in association with other commitments .Conclusions: The clause on the prohibition of the doctor–patient sexual relationship in Hippocratic oath was included to be for legal, economic and social reasons at the time. That the clause is found mostly in the ancient–medieval oaths can be attributed to the influence of the original. This commitment is generalised and associated with others by contemporary formulas. Currently, sexual relationships are the subject of legal and ethical analysis and their inclusion in the oaths is being debated. (shrink)

This booklet on Active Assisted Living (AAL) technologies has been created as part of the GoodBrother COST Action, which has run from 2020 to 2024. COST Actions are European research programs that promote collaboration across borders, uniting researchers, professionals, and institutions to address key societal challenges. GoodBrother focused on ethical and privacy concerns surrounding video and audio monitoring in care settings. The aim was to ensure that while AAL technologies help older adults and vulnerable individuals, their privacy and data protection (...) rights remain a top priority. This booklet is designed to guide you through the role that AAL technologies play in improving the quality of life for older adults, caregivers, and people with disabilities. AAL technologies offer tools for those facing cognitive or physical challenges. They can enhance independence, assist with daily routines, and promote a safer living environment. This study examined preschool children’s reasoning about and behavioral interactions with one of the most advanced robotic pets currently on the retail market, Sony’s robotic dog AIBO. Eighty children, equally divided between two age groups, 34–50 months and 58–74 months, participated in individual sessions with two artifacts: AIBO and a stuffed dog. Evaluation and justification results showed similarities in children’s reasoning across artifacts. In contrast, children engaged more often in apprehensive behavior and attempts at reciprocity with AIBO, and more often (...) mistreated the stuffed dog and endowed it with animation. Discussion focuses on how robotic pets, as representative of an emerging technological genre, may be blurring foundational ontological categories, and impacting children’s social and moral development. Requiring family authorization for apnea testing subtracts health professionals control over death determination, a procedure that has traditionally been considered a matter of clinical expertise alone. In this commentary, we first provide evidence showing that health professionals’ (HPs) disposition to act on death determination without family’s prior consent could be much lower than that referred to by Berkowitz and Garrett (2020). We hypothesize that HPs may have reservations about their own expertise as regards death, and may thus hesitate to impose (...) their views on patients’ families. We then address the theoretical question of clinical expertise in death determination by distinguishing judgments about facts (e.g., the presence or absence of spontaneous breathing) from interpretations given of these facts (i.e., their meaning for the vital status of an individual). We argue that, while clinicians may claim some expert authority on the former, they hold no particular authority on the latter. (shrink)

Opinions clash among different interpreters of Saint Thomas Aquinas. Stephen Brock's book provides both a magisterial (...) and a definitive answer to this question.Like fine wine, this book has been fermenting and maturing for almost thirty years. Originally a doctoral dissertation, this recently published work has been rewritten, and to a certain extent, reworked by the author with respect to some of its content.Without disregard for nuances, the first chapter introduces the reader to four different groups of Aquinas's interpreters. The first two groups question the full legal character of the natural law in its dependence to the eternal law. The third one questions its naturalness. The fourth group, instead, upholds both the divine origin of the natural law's full legality in its dependence on the eternal law, as well as its natural character.Brock places Dom Odo Lottin, Wolfgang Kluxen, Germain Grisez, and John Finnis in the first group. They maintain that the natural law is a law only in a qualified sense and that it does not entirely fulfill the definition of law. The natural law would provide an intrinsic morality. It should be treated independently from the eternal law. The second group is composed by authors such as Frederick Copleston, Alan Donagan, or Gregory Stevens. Similar to the first group, they argue that the natural law is an autonomous self-standing law, legislated by human reason. Thus, it should be treated independently from the eternal law, except to point out its ultimate origin.The author who exemplifies the third position is Ernest Fortin. Reacting against Finnis, Fortin's position jeopardizes the natural character of the natural law. In order to better appreciate the depth of this process, I have found it very helpful to read Farrell's The Natural Law According to Aquinas and Suarez in conjunction with Brock's work.The second chapter targets the natural law's legal character in its dependence to the eternal law. It proves that Thomas provides a strict definition of the natural law when he says that it is nothing but a participation of the eternal law in the rational creature. Medical professionals routinely offer prenatal genetic testing services to their expecting patients. In theory, this testing helps expecting parents better prepare for the birth of their child: e.g., if the child will have a disability. In practice, however, such testing often leads to the termination of pregnancies that would produce a child who has a disability. In many countries consumers have shown an increasing interest to the way in which food products are being produced. This study investigates Chinese consumers’ attitudes towards different pig production systems by means of a conjoint analysis. While there has been a range of studies on Western consumers’ attitudes to various forms of food production, little is known about the level of Chinese consumers’ attitudes. A cross-sectional survey was carried out with 472 participants in 6 Chinese cities. Results indicate that Chinese (...) consumers prefer industrial pig production systems, where traditional pig breeds are raised, over large-scale and small family farms. Farms with maximum attention to food safety, which furthermore can provide lean meat with consistent quality, are also preferred. Imported pig breeds and tasty but variable meat were rejected. A 3-cluster solution found that consumers from cluster 1 focus almost exclusively on the food safety aspect (food safety focused). Consumers from cluster 2 (indifferent) show weak overall attitudes to pig production systems in general. Cluster 3 (industrial production oriented) stands out by being very positive about industrial, large-size farms and consistent quality. From a Chinese consumer’s perspective, the industrial approach seems to represent values such as achievement and evolution, as well as quality and safety, since pig production is moving away from low-cost, low-quality, and low-safety family-scale systems. A complex set of rural and environmental development, quality aspects, and food safety measures are challenges that must be met by the stakeholders of pig production systems in China. (shrink)

No one who (...) is interested in Hobbes, however, can afford to overlook the two books that are reviewed here, the first, Quentin Skinner’s study of the relationship of Hobbes to rhetoric, and the second, Noel Malcolm’s edition of Hobbes’s correspondence.Skinner is well known not only as a leading British Hobbes scholar and historian of early modern political thought but likewise for his ideas concerning the correct method of studying the history of political philosophy. In a view akin to R. G. Collingwood’s he maintains that there are no permanent or perennial questions in political philosophy and that a historical approach based on a thorough comprehension of context is the only way to grasp what political philosophers are doing and saying when they write their texts. In implementing this prescription, he argues that to understand a historical text it is necessary to reconstruct its author’s intentions and the meaning of his ideas by ascertaining the linguistic conventions and usages and the intellectual currents and back-ground that form its context. He offers the present study both as an exem-plification of this method and as a new interpretation of the principles of Hobbes’s political philosophy which takes rhetoric as its focal theme. His aim, he tells us, is to situate Hobbes’s theory and practice of civil science within its intellectual context and to depict the philosopher less as the author of a philosophical system than as a contributor to a series of debates about the moral sciences within Renaissance culture. In this and many other cases, we always find, above all, a defense of truth and of its primacy over conscience and civil authority.1 In a culture that rapidly abandons Christendom and rejects the (...) Catholic social values once prevalent, this same issue is gaining prominence.Recent civil mandates related to Covid-19 vaccination are raising anew the challenging moral question, among faithful Catholics, concerning the legitimacy of civil disobedience.2 Part of the difficulty consists in the struggle [End Page 773] to harmonize two statements from the Congregation for the Doctrine of the Faith (CDF) concerning the Covid-19 vaccines.On the one hand, it is affirmed that, under certain circumstances, the use of some of these vaccines is morally permissible: "When ethically irreproachable Covid-19 vaccines are not available (e.g. in countries where vaccines without ethical problems are not made available to physicians and patients, or where their distribution is more difficult due to special storage and transport conditions, or when various types of vaccines are distributed in the same country but health authorities do not allow citizens to choose the vaccine with which to be inoculated) it is morally acceptable to receive Covid-19 vaccines that have used cell lines from aborted fetuses in their research and production process."3On the other hand, the CDF also affirms that vaccination should be voluntary; it is not obligatory as a rule: "Practical reason makes evident that vaccination is not, as a rule, a moral obligation and that, therefore, it must be voluntary."4Some Catholics are clinging to the first affirmation to advocate for the primacy of authority in the civil mandate to be vaccinated. Others, instead, are clinging to the second affirmation to uphold the primacy of conscience and the right to civil disobedience. The controversy is reaching a boiling point in the United States. It seems that tertium non datur.In this essay, however, aided by the guidance of our moral magisterium and Thomas Aquinas, we would like to show how these two statements from the CDF are not incompatible. We would like to offer a third option to the ones previously described. Our thesis is that the way to bring about the harmony of both statements consists in underscoring the primacy of truth, in our comprehension of conscience, authority, and civil disobedience.The essay will be divided into two different sections. The first section deals with the general principles at play in the Catholic understanding of conscience and civil disobedience under the primacy of truth. Thus, it focuses on providing some needed information to get rid of the relativistic and political lenses through which many Catholics today are approaching the vaccine mandates. The second section of the essay is instead more particular. It makes a moral evaluation of the recent mandates to be vaccinated. In this work we continue the study of these logics, providing sound and complete Hilbert-type axiomatic systems for each logic. We present evidence indicating new individual differences with people's intuitions about the relation of determinism to freedom and moral responsibility. We analysed participants' written explanations of why a person acted. Participants offered one of either 'decision' or 'causal' based explanations of behaviours in some paradigmatic cases. Those who gave causal explanations tended to have more incompatibilist intuitions than those who gave decision explanations. Importantly, the affective content of a scenario influenced the type of explanation given. Scenarios containing highly affective actions (...) (e.g. murder) tended to generate more decision explanations than scenarios with low affective content (e.g. cheating on taxes). These results give important clues about the proximal processes generating some intuitions about free will and moral responsibility. (shrink)

In Switzerland, the importance of transparency in animal experimentation is emphasized by the Swiss Federal Council, recognizing the public’s great interest in this matter. Federal reporting on animal experimentation indicates a total of 585,991 animals used in experiments in Switzerland in 2022. By Swiss law, the report enables the public to learn about many aspects such as the species and degree of suffering experienced by the animals, but some information of interest to the public is missing, such as the fate (...) of the animals at the end of the experiment (e.g., euthanized, rehomed in a private home, reused in another experiment). When it comes to animals bred in facilities but not used in experiments, further information of interest is not required to be made public according to Swiss law, for example, the number and fate of “surplus” animals (i.e., animals bred but not used in experiments for a variety of reasons such as not carrying the phenotypical properties needed). Considering that the Swiss government has a duty to provide a full accounting of animal experimentation conducted on the public’s behalf, further relevant information should be disclosed. While efforts toward transparency, such as the STAAR Agreement, have been made in the scientific community, these mostly reflect the legal requirements already in force. If Switzerland is to move toward more transparency in public information on animal experimentation, an update of the legal requirements is needed. In this article, we give recommendations for Swiss law to move toward more transparency in public information on seven aspects: (1) the fate of the animals at the end of the experiment; (2) the sources of funding for animal experimentation; (3) the harm-benefit analysis performed by researchers and ethics committees to justify an experiment using animals; (4) the number of breeding/surplus animals; (5) the fate of breeding/surplus animals; (6) the harms experienced by animals in facilities; and (7) the funding of animal facilities. The life of Saint Teresa of Jesus, the most famous mystic of sixteenth-century Spain, was characterized by recurrent visions and states of ecstasy. In this paper, we examine social components related to Teresa’s personal crises and the historical conditions of her times, factors that must be taken into account to understand these unusual forms of experience and behavior. Many of these factors (e.g., increasing individualism and reflexivity) are precursors of the condition of modern times. Indeed, certain parallels can be observed (...) between Saint Teresa and certain present-day psychopathological disorders. The analogy should not, however, be carried too far. Religion played a particularly crucial role in Teresa’s cultural context; as a result, it would be misleading to view her mystical experiences as resulting from a mental disorder. (shrink)

Emotions are complex reactions that allow individuals to cope with significant positive and negative events. Research on emotion was pioneered by Darwin’s work on emotional expressions in humans and animals. But Darwin was concerned mainly with facial and bodily expressions of significance for humans, citing mainly examples from mammals (e.g., apes, dogs, and cats). In birds, emotional expressions are less evident for a human observer, so a different approach is needed. Understanding avian emotions will provide key evolutionary information on the (...) evolution of related behaviors and brain circuitry. Birds and mammals are thought to have evolved from different groups of Mesozoic reptiles, theropod dinosaurs and therapsids, respectively, and therefore, their common ancestor is likely to be a basal reptile living about 300 million years ago, during the Carboniferous or Permian period. Yet, birds and mammals exhibit extensive convergence in terms of relative brain size, high levels of activity, sleep/wakefulness cycles, endothermy, and social behavior, among others. This article focuses on two basic emotions with negative valence: fear and frustration. Fear is related to the anticipation of dangerous or threatening stimuli (e.g., predators or aggressive conspecifics). Frustration is related to unexpected reward omissions or devaluations (e.g., loss of food or sexual resources). These results have implications for an understanding of the conditions that promote fear and frustration and for the evolution of supporting brain circuitry. (shrink)

Since the publication of my critical edition in 1889 the Tristia of Ovid has received some attention. A paper in Hermathena, vol. vii. by Professor R. Ellis contains several conjectural emendations, and in a public lecture on The Second Book of Ovid's ‘Tristia’ , this veteran scholar analysed the intricate contents of Book II. Two learned pamphlets by Dr. R. Ehwald, Ad historiam carminum Ouidianorum recensionemque symbolae deal with the history of the text, and the textual criticism and interpretation generally. (...) Dr. Paul Vogel's Kritische und exegetische Bemerkungen zu Ovid ‘Tristien’ is a valuable contribution to the understanding of the text and its interpretation. (shrink)

The sequencing of the human genome and decreasing costs of sequencing technology have led to the notion of ‘personalized medicine’. This has been taken by some authors to indicate that personalized medicine will provide individualized treatments solely based on one’s DNA sequence. We argue this is overly optimistic and misconstrues the notion of personalization. Such interpretations fail to account for economic, policy and structural constraints on the delivery of healthcare. Furthermore, notions of individualization based on genomic data potentially take us (...) down the road of genetic reductionism obscuring the role of environmental factors in disease and ill health. We propose that one should see personalized medicine as a way of using personal genomic information to stratify individuals into subpopulations and suggest that personalized medicine be seen within a broader idea of personalized healthcare, reflecting healthcare that integrates personal genomic data into cultural, environmental and personal contexts. This study investigates hitherto unknown sources of Leibniz' thought in late scholasticism. It focusses on the idea of a "best of all possible worlds" and its origins in discussions about possibility, freedom and foreknowledge in the early modern period.

Over the past two years, debate about the use of data taken from Nazi concentration camp experiments has intensified. Many survivors of the Holocaust have been particularly offended at the publication of hypothermia or other data. This article argues against the use of unethically obtained data, and considers the debate from the perspective of the rights of Holocaust victims.

That death has ever been a problem to man is attested as far back as we can trace our species in the archaeological record—indeed, it seems to have been a problem even for that immediate precursor of homo sapiens, the so-called Neanderthal Man; for he buried his dead.

Moral case deliberation (MCD) is a specific form of clinical ethics, aiming to stimulate ethical reflection in daily practice in order to improve the quality of care. This article focuses on the implementation of MCD in nursing homes and the questions how and where to organize MCD. The purpose of this study was to evaluate one way of organizing MCD in two Dutch nursing homes. In both of these nursing homes the MCD groups had a heterogeneous composition and were organized (...) apart from existing institutional communication structures. As part of a naturalistic evaluation, systematic observations, interviews and focus groups were completed. The findings indicate that the heterogeneous composition and MCD meetings separate from existing structures have benefits. However, the participants also reported negative experiences. This gives rise to the question whether a mixed MCD group which meets separately is an effective way to embed MCD as an instrument for reflection on moral issues in daily practice. We conclude that there is no single answer to that question. In the end, the two implementation strategies (i.e. within existing communication structures and a mixed MCD group) can be complementary to each other. (shrink)

This new translation of The Logic of the Cultural Sciences _ _makes Ernst Cassirer’s classic study, long out of print, available to English readers. A German Jew living in exile at the beginning of the Second World War, Cassirer wrote this book—one of his clearest and most concise—in response to the crises besetting his era. It represented to him a rethinking and completion of his magnum opus _The Philosophy of Symbolic Forms. _S. G. Lofts’s translation stays close to the original (...) German and accurately reflects the echoes of the philosophical debates of Cassirer’s day. In the book’s five linked studies, Cassirer considers the intellectual structure of the disciplines we commonly refer to as the humanities. He defines and justifies the basic philosophical perspective of the philosophy of symbolic forms, and he contributes a wealth of ideas to continuing debates about culture and what is unique in human nature. Transplantation continues to push the frontiers of medicine into domains that summon forth troublesome ethical questions. Looming on the frontier today is human facial transplantation. We develop criteria that, we maintain, must be satisfied in order to ethically undertake this as-yet-untried transplant procedure. We draw on the criteria advanced by Dr. Francis Moore in the late 1980s for introducing innovative procedures in transplant surgery. In addition to these we also insist that human face transplantation must meet all the ethical requirements (...) usually applied to health care research. We summarize the achievements of transplant surgery to date, focusing in particular on the safety and efficacy of immunosuppressive medications. We also emphasize the importance of risk/benefit assessments that take into account the physical, aesthetic, psychological, and social dimensions of facial disfiguration, reconstruction, and transplantation. Finally, we maintain that the time has come to move facial transplantation research into the clinical phase. (shrink)
